The term was coined by the supporters and therefore they technically "own" it. Everyone knows Arsenal is associated with "The Gooners" and, like you said, the final outcome of this is just some die hard fan being sued. Besides, if this does indeed go through, it will open the door to every club wanting to get their nicknames and mascot's name trademarked. Yea, don’t like the idea too much.
